Terms of Service

1. The basics

These terms are a contract between you ("you", "the customer") and Niche Websites ("we", "us"), contactable at [email protected].

They govern your use of the Niche Websites platform — the software, hosting and services made available at nichewebsites.co.uk and on any site we deploy on your behalf ("the Service").

By signing up, paying for a subscription, or using the Service in any way, you agree to these terms. If you don't agree, don't use the Service.

2. Your account

You must be at least 18 years old and legally able to enter into a contract in your jurisdiction. If you're signing up on behalf of a company, you confirm you have authority to bind that company.

You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us straight away at [email protected] if you think your account has been accessed by someone else.

3. Subscriptions, renewals and cancellations

The Service is offered on an annual subscription basis. Current plans and prices are shown at nichewebsites.co.uk/#pricing. Fees are payable in advance and non-refundable except as set out in section 4.

Automatic renewal. Subscriptions renew automatically on their anniversary at the then-current price. We'll email you at least 14 days before renewal. You can cancel renewal at any time by emailing us — your site will remain active until the end of the paid period.

Price changes. We may change subscription prices, but any change only applies to renewals — not to a period you've already paid for. We'll give you at least 30 days' notice of any renewal price change so you can decide whether to continue.

4. Refund policy

14-day money-back guarantee. If you're not happy in the first 14 days from your signup date, contact us at [email protected] for a refund.

• Self-Service plan: full refund of the subscription fee.
• Managed plan: refund of the subscription fee, less £9.99 retained to cover the non-refundable third-party domain registration fee already paid to the registrar on your behalf.

The 14 days runs from the date you sign up, not the date your site launches. After 14 days, subscription fees are non-refundable.

5. Domain names

Self-Service. You use your own domain (or a free subdomain of nichewebsites.co.uk). If you use your own domain, you own it and are responsible for renewing it.

Managed. As part of the Managed plan, we register a domain on your behalf using our third-party registrar account. This domain is registered in our name. While your subscription is active, the domain is dedicated exclusively to your site and behaves in every practical sense as yours.

What this means if you leave. If your Managed subscription ends for any reason (non-renewal, cancellation after the 14-day period, or termination for breach), we retain the domain along with the site and its content. This is a deliberate feature of the Managed plan — the fee reflects the fact that we build and maintain an SEO asset — and by choosing Managed you accept this arrangement.

6. AI API keys and third-party services

The Service requires an AI API key (Anthropic, OpenAI or a supported equivalent) to generate suggestions. You are responsible for:

• Obtaining and paying for your own API key.
• Any usage charges billed to that key by the AI provider.
• Complying with the AI provider's own terms of service.

We help you set the key up but we do not resell, cover, or subsidise AI usage costs. If your key stops working (revoked, expired, out of credit), your site's AI features will stop working until it's fixed — this is not a fault of the Service and does not entitle you to a refund.

The Service also relies on other third parties (hosting, payment processing, domain registrar, analytics). We're not liable for outages, changes or issues at those providers, though we'll work in good faith to resolve them.

7. Your content and site ownership

You retain ownership of any original content you upload (logos, images, custom text). By uploading it, you grant us the right to host, display and back it up as needed to run the Service.

Content generated by the AI in response to visitor queries is stored on the site as part of its normal operation. This content is generated using your API key but forms part of the operating record of the site — which, on the Managed plan, we retain if you leave (see section 5).

You confirm you have the rights to any content you upload and that it doesn't infringe anyone else's rights.

8. Our platform and intellectual property

The Niche Websites software, admin panel, templates, name, branding and underlying code are our property. A subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for the duration of your paid subscription. You may not:

• Copy, resell, sub-licence, or redistribute the software or any part of it.
• Reverse-engineer, decompile, or attempt to extract the source code.
• Remove or obscure the "Powered by nichewebsites.co.uk" footer link without our written permission.

9. Acceptable use

You may not use the Service to:

• Publish content that is illegal, defamatory, obscene, hateful, or infringes intellectual property or privacy rights.
• Send spam, phishing content, or malware.
• Circumvent affiliate programme terms, or engage in cookie-stuffing or fraudulent affiliate activity.
• Attempt to interfere with the Service, other customers' sites, or the underlying infrastructure.
• Compete directly with the Service by using it as a platform for a rival product.

We may suspend or terminate accounts that breach these rules, without refund.

10. Uptime and availability

We aim for high availability but don't guarantee uninterrupted service. Occasional planned maintenance and unexpected outages are inevitable. We'll do our reasonable best to minimise disruption and don't credit or refund for short outages.

11. Termination

By you. You may cancel at any time by emailing [email protected]. Your site remains active until the end of the paid period; no partial refunds outside the 14-day window.

By us. We may suspend or terminate your account if you materially breach these terms, don't pay, or use the Service in a way that puts our infrastructure or other customers at risk. We'll give you reasonable notice where possible.

Effect of termination. On termination, your access to the admin panel ends. For Self-Service customers, we'll provide a reasonable export of your custom content on request within 30 days. For Managed customers, the domain and site remain with us as set out in section 5.

12. Liability

The Service is provided "as is". We make no warranties about specific outcomes — including but not limited to search engine rankings, traffic levels, or earnings. Success depends on many factors outside our control, including niche choice, competition, Google's algorithms, and the effort you put in.

To the fullest extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the amount you've paid us in the 12 months before the claim arose.

We're not liable for indirect or consequential losses — including lost profits, lost revenue, or loss of goodwill.

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or anything else that can't be limited by law under the Consumer Rights Act 2015.

13. Changes to these terms

We may update these terms from time to time. If a change is material, we'll notify you by email at least 14 days in advance. Continued use of the Service after the change takes effect means you accept the updated terms. If you don't accept them, you can cancel — and if the change is materially adverse to you, we'll refund any unused portion of a prepaid subscription.

14. Governing law

These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
